1. Acceptance of Terms

By creating an account on, making a purchase through, or otherwise accessing or using Calibrate (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms form a legally binding agreement between you and Calibrate Ltd. Your continued use of the Service after any amendments to these Terms, notified in accordance with Section 13, constitutes acceptance of the amended Terms.

2. Trader Identity and Pre-Contractual Information

In compliance with the Electronic Commerce (EC Directive) Regulations 2002 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Regulations 9-16), the following information is provided. Trader name: Calibrate Ltd, a company registered in England and Wales (company number 17109642). Registered office: 128 City Road, London, United Kingdom, EC1V 2NX. Contact email: legal@calibrate-system.com. Support email: support@calibrate-system.com. VAT status: Calibrate Ltd is not currently registered for VAT. Calibrate is not a member of any professional body or trade association, and its services are not subject to any authorisation scheme. The main characteristics of the Service are described in Section 3. All prices are displayed in US Dollars (USD) and are inclusive of any applicable taxes unless otherwise stated. Before completing any purchase, you will be provided with a clear summary of the total price, the digital content being purchased, and your rights under these Terms.

3. Description of the Service

Calibrate is a digital platform that offers structured behavioral change programs grounded in cognitive psychology research. The Service includes: (a) a Cognitive Diagnostic Index (CDI) assessment quiz, which requires an email address to view results; (b) paid structured programs — AUDIT (7 days, $69), RECODE (14 days, $129), and IRREVERSIBLE (21 days, $189) — each covering 7 life areas; (c) digital content, exercises, and personalized tracking tools. All programs provide immediate access to digital content upon successful payment. Programs are offered on a one-time payment basis with no recurring charges or automatic renewals.

4. Account Terms

To access certain features of the Service, you must create an account. You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old. If we discover or have reason to believe that an account holder is under 18, we will terminate the account immediately. You are responsible for: maintaining the confidentiality of your login credentials, all activities that occur under your account, and providing accurate and up-to-date information. You must not share your account credentials or allow any third party to access your account. You must notify us immediately at support@calibrate-system.com of any unauthorized use of your account or any other breach of security.

5. Payment Terms

Paid programs are subject to the following conditions: all prices are displayed and charged in US Dollars (USD). Payment is processed securely through Stripe, our third-party payment processor. Access to the purchased program is granted immediately after successful payment. All prices displayed on the pricing page are the total price inclusive of any applicable taxes, unless otherwise clearly stated at the point of purchase. If a payment fails, access to the program will not be granted until the payment is successfully completed. Calibrate does not store your payment card details; all payment information is handled directly by Stripe in accordance with PCI-DSS standards. 6. Quiz, Assessment, and Results Disclaimer

The Cognitive Diagnostic Index (CDI) assessment and all associated content, programs, exercises, and materials provided through the Service are offered for informational, educational, and self-improvement purposes only. Calibrate is NOT a medical, therapeutic, clinical, or diagnostic service. The Service does NOT constitute and must not be relied upon as: medical advice, diagnosis, or treatment; psychological therapy, psychotherapy, or counseling; psychiatric or clinical assessment; a substitute for professional mental health, medical, or healthcare services; crisis intervention or emergency support. The CDI is a behavioral self-assessment tool based on published cognitive science research. It is not a validated clinical instrument, and its results do not constitute a clinical diagnosis of any kind. Individual results may vary and are not guaranteed. No specific outcomes, improvements, or behavioral changes are promised or implied by the use of any program. If you are experiencing mental health difficulties, emotional distress, or any medical condition, please consult a qualified healthcare professional immediately. If you are in crisis, contact your local emergency services. Calibrate is not responsible for any decisions made, or actions taken or not taken, based on assessment results or program content.

7. Intellectual Property

All content on the Service — including but not limited to text, graphics, logos, methodologies, assessments, program structures, exercises, audio content, algorithms, software, and the CDI scoring system — is the property of Calibrate Ltd or its licensors and is protected by UK and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the content solely for your personal, non-commercial use in connection with the program you have purchased. You may not reproduce, distribute, modify, publicly display, create derivative works from, reverse-engineer, or commercially exploit any content without prior written authorization from Calibrate Ltd.

8. User Content and Data

By using the Service, you retain ownership of your personal data and assessment responses. You grant Calibrate Ltd a limited, non-exclusive license to use this data solely for: providing and improving the Service, and generating anonymized aggregate statistics that cannot be used to identify you. Your data is processed in accordance with our Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

9. Limitation of Liability

Nothing in these Terms excludes or limits Calibrate Ltd's liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under the Consumer Rights Act 2015 or any other applicable law. Subject to the above, and to the maximum extent permitted by applicable law: the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement; Calibrate Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill; our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to Calibrate Ltd in the 12 months immediately preceding the event giving rise to the claim. For consumers in the United Kingdom, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. For additional provisions applicable to US consumers, see Section 14.

10. Termination

You may terminate your account at any time through your account settings or by emailing support@calibrate-system.com. Calibrate Ltd may suspend or terminate your account if: you violate these Terms, your account shows suspicious or fraudulent activity, or we are required to do so by law. Upon termination: your right to access paid programs you have purchased remains valid for the duration specified for that program, subject to these Terms; your personal data will be handled in accordance with our Privacy Policy, including any applicable retention periods required by law; anonymized and aggregated data that cannot identify you may be retained indefinitely. Termination does not affect any rights or obligations that accrued prior to the date of termination, including your right to request a refund under Section 11 if still within the applicable period.

11. Right of Withdrawal and Refund Policy

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCR 2013"), you have the right to cancel your purchase within 14 days of the date of purchase without giving any reason (the "Withdrawal Period"). Our programs provide immediate access to digital content. In accordance with Regulation 37 of the CCR 2013, before completing your purchase you will be asked to: (a) give your express consent to the supply of digital content beginning immediately, before the end of the Withdrawal Period; (b) acknowledge that by giving such consent, you will lose your statutory right of withdrawal under the CCR 2013 once the supply of digital content has begun; and (c) receive confirmation of this consent and acknowledgment on a durable medium (email confirmation). All three conditions (a), (b), and (c) must be satisfied for the waiver of your withdrawal right to take effect. If any of these conditions is not met, your right of withdrawal is preserved for up to 12 months and 14 days from the date of purchase. Commercial guarantee: regardless of the above statutory provisions, Calibrate Ltd offers a voluntary 14-day money-back guarantee on all programs. Within 14 days of your purchase, you may request a full refund for any reason by contacting support@calibrate-system.com. This commercial guarantee is in addition to, and does not affect, your statutory rights. For full details, see our Refund Policy. 12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. For any dispute arising from or related to these Terms or the use of the Service, the courts of England and Wales shall have non-exclusive jurisdiction. This means you may bring proceedings in England and Wales or in the courts of the country in which you reside. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law. For consumers resident in the United States, see Section 14 for additional provisions that apply to you, including preservation of your rights under applicable state and federal consumer protection laws.

13. Modifications to Terms

Calibrate Ltd reserves the right to modify these Terms at any time. Significant changes will be communicated to you via email to the address associated with your account at least 30 days before they take effect. If email notification is not possible, we will provide a prominent notice on the Service. Minor administrative or formatting changes that do not materially affect your rights may be made without advance notice. Continued use of the Service after the effective date of any modification constitutes acceptance of the modified Terms. If you do not agree with a modification, you may terminate your account before the effective date in accordance with Section 10.

14. Additional Provisions for United States Consumers

This section applies to you if you are a resident of the United States. Age requirement: You must be at least 18 years of age to use the Service. Warranty disclaimer: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CALIBRATE LTD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. THIS DISCLAIMER OF WARRANTIES IS AN ESSENTIAL PART OF THESE TERMS. Results disclaimer: Calibrate is a behavioral self-assessment and educational platform. It is not a medical, therapeutic, or clinical service. No specific results, behavioral changes, or improvements are guaranteed. Individual experiences may vary. The CDI score is not a clinical diagnosis. Nothing in the Service should be construed as medical advice, and the Service is not intended to diagnose, treat, cure, or prevent any disease or condition. Consumer rights: Nothing in these Terms is intended to limit your rights under applicable US federal or state consumer protection laws, including but not limited to the Federal Trade Commission Act, the Magnuson-Moss Warranty Act, and applicable state consumer protection statutes. You retain the right to bring claims before your state attorney general or relevant consumer protection agencies. California residents: In accordance with California Civil Code Section 1789.3, California consumers are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

15. Dispute Resolution

Before initiating any formal legal proceedings, you agree to first contact Calibrate Ltd at legal@calibrate-system.com and attempt to resolve the dispute informally for a period of at least 30 days. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts having jurisdiction as set out in Section 12. Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction at any time. Small claims: Nothing in these Terms prevents you from bringing a claim in the small claims court of your jurisdiction, provided the claim falls within that court's monetary limits. For UK consumers, you may also access the European Commission's Online Dispute Resolution platform for information (although the UK is no longer an EU member state, this resource may still provide useful guidance). For US consumers, you retain the right to file complaints with the Federal Trade Commission (ftc.gov), your state attorney general, or the Better Business Bureau.
